SSL or TLS encryption

This site uses SSL or TLS encryption for security reasons and for the protection of the transmission of confidential content, such as the inquiries you send to us as the site operator. Encrypted payments on this website

If you enter into a contract which requires you to send us your payment information (e.g. account number for direct debits), we will require this data to process your payment.

Payment transactions using common means of payment (Visa/MasterCard, direct debit) are only made via encrypted SSL or TLS connections. In the case of encrypted communication, any payment details you submit to us cannot be read by third parties.

Information, blocking, deletion

As permitted by law, you have the right to be provided at any time with information free of charge about any of your personal data that is stored as well as its origin, the recipient and the purpose for which it has been processed. You also have the right to have this data corrected, blocked or deleted. Opposition to promotional emails

We hereby expressly prohibit the use of contact data published in the context of website legal notice requirements with regard to sending promotional and informational materials not expressly requested. The website operator reserves the right to take specific legal action if unsolicited advertising material, such as email spam, is received.

3. Data collection on our website

Cookies

Server log files

The website provider automatically collects and stores information that your browser automatically transmits to us in server log files. These are:

  • Time of the server request

    These data will not be combined with data from other sources.

The basis for data processing is Art. 6 (1) (f) DSGVO, which allows the processing of data to fulfill a contract or for measures preliminary to a contract.

Contact form

Should you send us questions via the contact form, we will collect the data entered on the form, including the contact details you provide, to answer your question and any follow-up questions. We do not share this information without your permission.

We will, therefore, process any data you enter onto the contact form only with your consent per Art. 6 (1)(a) DSGVO. You may revoke your consent at any time. An informal email making this request is sufficient. The data processed before we receive your request may still be legally processed.

We will retain the data you provide on the contact form until you request its deletion, revoke your consent for its storage, or the purpose for its storage no longer pertains (e.g. after fulfilling your request). Any mandatory statutory provisions, especially those regarding mandatory data retention periods, remain unaffected by this provision.

Registration on this website

You can register on our website in order to access additional functions offered here. The input data will only be used for the purpose of using the respective site or service for which you have registered. The mandatory information requested during registration must be provided in full. Otherwise, we will reject your registration.

To inform you about important changes such as those within the scope of our site or technical changes, we will use the email address specified during registration.

We will process the data provided during registration only based on your consent per Art. 6 (1)(a) DSGVO. You may revoke your consent at any time with future effect. We will continue to store the data collected during registration for as long as you remain registered on our website. Statutory retention periods remain unaffected.

Processing of data (customer and contract data)

We collect, process, and use personal data only insofar as it is necessary to establish, or modify legal relationships with us (master data). This is done based on Art. 6 (1) (b) DSGVO, which allows the processing of data to fulfill a contract or for measures preliminary to a contract. We collect, process and use your personal data when accessing our website (usage data) only to the extent required to enable you to access our service or to bill you for the same.

Collected customer data shall be deleted after completion of the order or termination of the business relationship. Legal retention periods remain unaffected.

Data transmitted when entering into a contract with online shops, retailers, and mail order

We transmit personally identifiable data to third parties only to the extent required to fulfill the terms of your contract, for example, to companies entrusted to deliver goods to your location or banks entrusted to process your payments. Your data will not be transmitted for any other purpose unless you have given your express permission to do so. Your data will not be disclosed to third parties for advertising purposes without your express consent.

The basis for data processing is Art. 6 (1) (b) DSGVO, which allows the processing of data to fulfill a contract or for measures preliminary to a contract.

Data transferred when signing up for services and digital content

We transmit personally identifiable data to third parties only to the extent required to fulfill the terms of your contract with us, for example, to banks entrusted to process your payments.

Your data will not be transmitted for any other purpose unless you have given your express permission to do so. Your data will not be disclosed to third parties for advertising purposes without your express consent.

The basis for data processing is Art. 6 (1) (b) DSGVO, which allows the processing of data to fulfill a contract or for measures preliminary to a contract.

4. Consent, analytics and advertising measurement

Your privacy choices

We determine a visitor's broad consent region from the country code supplied by our hosting provider. We do not use or store a full IP address for this decision. Visitors in the European Economic Area, the United Kingdom and Switzerland are asked before optional analytics or marketing technologies are loaded. Visitors in other regions can change their choices at any time using “Privacy choices” in the footer. Where supported, we honor the browser's Global Privacy Control signal by disabling marketing measurement.

When you make an explicit choice, we store the necessary, versioned cw_consent cookie for 180 days. It records only your category choices and uses Secure and SameSite=Lax protections. Choices granted automatically outside opt-in regions are not stored. Withdrawing a category removes the related cookies and campaign storage from this browser and prevents the corresponding tag from loading on the next page load.

Google Tag Manager and Google Analytics 4

Google Tag Manager, provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, manages our optional Google Analytics 4, ChatGPT Ads and Reddit tags. In opt-in regions, Tag Manager is not requested until at least one optional category has been accepted.

Google Analytics 4 is enabled only when the Analytics category is allowed. It measures page views, the current URL and path, page title, referrer, approximate location, and browser/device information. Google may set first-party cookies such as _ga and _ga_*; Google documents a default lifetime of up to two years, subject to browser limits and our Analytics settings. Google acts as our processor for Analytics data under the applicable Google data-processing terms. User- and event-level retention follows the retention configured for our GA4 property; aggregated reports may be retained for longer.

For visitors where consent is legally required, the legal basis is consent under Art. 6(1)(a) GDPR and Section 25(1) TDDDG. Elsewhere, processing is based on our legitimate interest in understanding and improving the website, Art. 6(1)(f) GDPR where applicable, subject to local opt-out rights. Reddit Pixel

The Reddit Pixel is provided by Reddit, Inc., 303 Second Street, South Tower, 5th Floor, San Francisco, CA 94107, USA. When the Marketing category is allowed, it sends a PageVisit event for the initial page and client-side navigation so Reddit can attribute visits and actions to Reddit advertising. The event can include the page URL, referrer, browser/device data, IP-derived information, and Reddit identifiers. Reddit may set or read identifiers such as _rdt_uuid.

In opt-in regions, the legal basis is consent under Art. 6(1)(a) GDPR and Section 25(1) TDDDG. In the United States and other non-opt-in regions, we rely on our legitimate interest in measuring advertising effectiveness, subject to applicable opt-out rights. A Global Privacy Control signal or a manual Marketing opt-out blocks Reddit tracking and clears Reddit identifiers available to us. Reddit processes pixel data under the Reddit Business Tool Terms, its advertising data-processing terms, and the Reddit Privacy Policy. Reddit retains data according to those terms and the settings of its advertising platform.

ChatGPT Ads Measurement Pixel

When the Marketing category is allowed, the OpenAI Measurement Pixel measures visits and actions that may be attributed to ads shown in ChatGPT. OpenAI appends a privacy-preserving click reference called oppref to eligible landing-page URLs. The Pixel stores it in the first-party __oppref cookie and associates it with later events such as a completed registration, trial or subscription. We preserve oppref when you continue from this website to the ChartsWatcher application. Depending on the event, the Pixel can also receive the current page origin, event time, browser/device data and order or plan information. We do not send raw payment-card details to OpenAI.

In opt-in regions, the legal basis is consent under Art. 6(1)(a) GDPR and Section 25(1) TDDDG. Elsewhere, processing is based on our legitimate interest in measuring advertising effectiveness, Art. 6(1)(f) GDPR where applicable, subject to local opt-out rights. A Global Privacy Control signal or a manual Marketing opt-out blocks the Pixel and removes the OpenAI click-reference cookie available to us. For more information, see OpenAI's Privacy Policy.

Campaign parameters

When Marketing is allowed, we store landing-page campaign query parameters, including eligible advertising click references such as oppref, in this browser's local storage under queryParams for up to 30 days. They are forwarded only to links leading to the ChartsWatcher application so a campaign can be attributed across that hand-off. Rejecting or withdrawing Marketing removes this entry.

Vercel Analytics and Cloudflare Web Analytics

We use Vercel Web Analytics and Cloudflare Web Analytics for privacy-focused, aggregate traffic and performance statistics. These integrations do not use cookies or local storage to recognize visitors across websites and remain active independently of the optional categories. Vercel derives a daily visitor hash from a request and discards the visitor session after 24 hours. Cloudflare states that its Web Analytics does not collect or use visitors' personal data; unsampled beacon data is retained for seven days and longer-term reporting is aggregated. Recipients, transfers and retention

Google, OpenAI, Reddit, Vercel and Cloudflare may process information in the United States and other countries outside your country of residence. Where required, transfers are covered by the providers' applicable data-processing agreements and recognized transfer mechanisms, such as Standard Contractual Clauses. We retain our analytics and advertising reports only as long as needed for measurement, security and legal obligations; provider-side retention is additionally governed by the settings and terms described above. You can withdraw future processing at any time through the footer's privacy control. Withdrawal does not affect processing that was lawful before it took effect.

5. Newsletter

Newsletter data

If you would like to receive our newsletter, we require a valid email address as well as information that allows us to verify that you are the owner of the specified email address and that you agree to receive this newsletter. No additional data is collected or is only collected on a voluntary basis. We only use this data to send the requested information and do not pass it on to third parties.

We will, therefore, process any data you enter onto the contact form only with your consent per Art. 6 (1) (a) DSGVO. You can revoke consent to the storage of your data and email address as well as their use for sending the newsletter at any time, e.g. through the unsubscribe link in the newsletter. The data processed before we receive your request may still be legally processed.

The data provided when registering for the newsletter will be used to distribute the newsletter until you cancel your subscription when said data will be deleted. Data we have stored for other purposes (e.g. email addresses for the members area) remain unaffected.

6. Plugins and tools

Google Web Fonts

For uniform representation of fonts, this page uses web fonts provided by Google. When you open a page, your browser loads the required web fonts into your browser cache to display texts and fonts correctly.

For this purpose your browser has to establish a direct connection to Google servers. Google thus becomes aware that our web page was accessed via your IP address. The use of Google Web fonts is done in the interest of a uniform and attractive presentation of our website. This constitutes a justified interest pursuant to Art. 6 (1) (f) DSGVO.

If your browser does not support web fonts, a standard font is used by your computer.

YouTube

Our website uses plugins from YouTube, which is operated by Google. The operator of the pages is YouTube LLC, 901 Cherry Ave., San Bruno, CA 94066, USA.

If you visit one of our pages featuring a YouTube plugin, a connection to the YouTube servers is established. Here the YouTube server is informed about which of our pages you have visited.

If you"re logged in to your YouTube account, YouTube allows you to associate your browsing behavior directly with your personal profile. You can prevent this by logging out of your YouTube account.

YouTube is used to help make our website appealing. This constitutes a justified interest pursuant to Art. 6 (1) (f) DSGVO.

7. Hosting and backend infrastructure

This type of service has the purpose of hosting Data and files that enable this Website to run and be distributed as well as to provide a ready-made infrastructure to run specific features or parts of this Website.

This website uses the hosting services provided by Amazon Web Services, Inc., 410 Terry Avenue North, Seattle WA 98109, USA.

8. Payment service providers

Payment processing services enable ChartsWatcher to process payments by credit card, bank transfer or other means. To ensure greater security, ChartsWatcher shares only the information necessary to execute the transaction with the financial intermediaries handling the transaction.

Some of these services may also enable the sending of timed messages to the user, such as emails containing invoices or notifications concerning the payment.

Data is transmitted to Paddle based on Art. 6 (1)(a) (Consent) and Art. 6 (1)(b) DSGVO (Processing for contract purposes). You have the option to revoke your consent at any time with future effect. It does not affect the processing of data previously collected. 

Paddle.com UK (Paddle.com Market Ltd) and Paddle.com Ireland (Paddle Payments Ltd)

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
